Property Dispute FAQs
+ What sort of property disputes can Betar Lawyers help with?
There are many causes of property disputes, ranging from those which occur during the conveyancing process to issues with neighbours (such as tree, boundary or fencing disputes) and disputes involving co-owners of a property and caveat disputes.
At Betar Lawyers we give expert legal advice and representation in all types of property dispute cases.
The most common issues we help with involve conveyancing disputes, such as termination of contracts. For instance, someone buying your home may fail to complete their settlement of purchase during the conveyancing process, and there is a requirement to terminate the contract.
If this happens, as the seller you have the right to receive the deposit and this is called forfeiture of the deposit. Sometimes a purchaser may dispute the release of the deposit, so a Court will be asked to intervene and adjudicate the dispute.
+ Do property disputes always go to Court?
No, not always. With the right legal expertise and advice, it’s possible to reach agreement and avoid Court - and all its associated costs - altogether.
At Betar Lawyers this is what we strive to achieve, through robust and practical advice. Although it may not be what you expected, it will often place you in a better position.
The best thing you can do is contact us as early as possible so we can understand your situation and how it can be resolved. Call us on (02) 9279 1100.
+ What chance do I have of winning my property dispute case?
Some cases have a high or very high chance of success. Everything depends on the facts of the case, your circumstances and where you legally stand. We will always provide you with direct and clear advice about your options.
+ Someone registered a caveat on my property. How do I get rid of it?
“Caveat” is a Latin word literally meaning ‘let a person beware’. It is an incredibly powerful document which can stop a property transaction dead in its tracks. It is important to follow the strict legal steps in order to remove a caveat. Sometimes, there is no basis for the caveat being registered. Other times there is. Please contact Betar Lawyers on 02 9279 1100 for further advice.
+ My conveyancer is having trouble getting a buyer to settle the purchase of our property. Can you help?
As professional legal advisers, we often take over difficult property transactions that require a ‘delicate legal hand’ to move things forward. We have successfully completed sales of real estate for clients when the conveyancer was unable to get a purchaser to do so. In these instances, we can provide effective solutions without an enormous cost. Call us for advice on 02 9279 1100.
+ Can you give us independent and object advice on a property transaction we’re considering?
Yes, Justin Betar often provides independent property transaction advice. We find that being independent of a transaction gives us a unique opportunity to objectively assess a transaction, the weak points, the strong points and strategies to move forward. This can provide you with piece of mind and certainty.
